By accessing or using the EVSpot platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
Introduction
These Terms of Service ("Terms") govern your access to and use of EVSpot's website, mobile application, and services (collectively, the "Service"), operated by EVSpot Kenya.
Our Service provides a platform for users to find, submit, and verify electric vehicle (EV) charging stations across Kenya. By accessing or using our Service, you agree to be bound by these Terms. Please read them carefully.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
Any disputes arising out of or relating to these Terms or the Service shall be resolved through the courts of Kenya, and you consent to the exclusive jurisdiction and venue of the courts located in Nairobi for any such disputes.
Service Availability
EVSpot is primarily designed for users in Kenya. While we strive to make our Service available 24/7, we do not guarantee that the Service will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Service, resulting in interruptions, delays, or errors.
We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Service at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Service during any downtime or discontinuance of the Service.
User Accounts
Account Creation and Responsibility
When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Account Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
User Contributions
Our Service allows you to submit, post, and share information about EV charging stations ("User Contributions"). You are solely responsible for the accuracy and completeness of your User Contributions.
Content Ownership
You retain all ownership rights to your User Contributions. However, by submitting User Contributions to the Service, you grant EVSpot a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Contributions in connection with the Service.
Content Guidelines
You agree not to submit User Contributions that:
- Are false, inaccurate, or misleading
- Violate any third-party right, including copyright, trademark, privacy, or other personal or proprietary rights
- Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable
- Promote discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group
- Promote illegal activities or conduct
- Advertise or promote a commercial product or service without our prior written consent
- Impersonate any person, or misrepresent your identity or affiliation with any person or organization
- Involve commercial activities such as contests, sweepstakes, or promotions without our prior written consent
We reserve the right to remove any User Contributions that violate these guidelines or that we determine to be otherwise harmful, objectionable, or inaccurate.
Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy.
We comply with the Data Protection Act of Kenya (2019) and other applicable laws regarding the collection, storage, and processing of personal data.
Prohibited Activities
In addition to the content guidelines mentioned above, you agree not to use the Service:
No Illegal Use
To violate any applicable national or international law, rule, or regulation.
No Interference
To interfere with or disrupt the Service or servers or networks connected to the Service.
No Data Mining
To data mine, scrape, crawl, or spider any part of the Service without our prior written consent.
No Impersonation
To impersonate or attempt to impersonate EVSpot, an EVSpot employee, another user, or any other person or entity.
No Malicious Code
To transmit or attempt to transmit any viruses, malware, or other code of a destructive nature.
No Unauthorized Access
To access or attempt to access any part of the Service that you are not authorized to access.
Limitation of Liability
To the maximum extent permitted by law, EVSpot and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
- Reliance on information about charging stations provided through the Service
The information about charging stations provided through the Service is contributed by users and may not always be accurate or up-to-date. EVSpot does not guarantee the accuracy, completeness, or reliability of any charging station information.
Important Notice
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. EVSpot disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
